Dispute Resolution
Any dispute arising under this Agreement shall first be attempted to be resolved through good faith negotiation by contacting support@pandapeptides.com. Both parties agree to attempt to resolve any dispute within thirty (30) days of written notice of the dispute.
If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution exclusively in the state or federal courts located in Sacramento County, California. You consent to personal jurisdiction and venue in such courts.
Class Action Waiver: You agree to waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding against Xylo Research Systems LLC, dba Panda Peptides. Any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
JURY TRIAL WAIVER: TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE TRANSACTIONS CONTEMPLATED HEREIN.
Binding Arbitration

The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Small Claims Court Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes where the amount in controversy is $10,000 or less, provided the claim is within the jurisdiction of the small claims court.
Costs and Fees: Each party shall bear its own costs and attorneys’ fees in any arbitration, except that the arbitrator may award costs and fees to the prevailing party if permitted by applicable law. If you demonstrate that the costs of arbitration would be prohibitive compared to the costs of litigation, Xylo Research Systems LLC, dba Panda Peptides will pay as much of the filing and hearing fees as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive.
Opt-Out: You may opt out of this arbitration provision by sending written notice to support@pandapeptides.com within 30 days of your first purchase from Panda Peptides. Your notice must include your name, address, and a clear statement that you wish to opt out of binding arbitration.
Time Limitation on Claims
TIME LIMITATION ON CLAIMS: Any claim arising out of or related to this Agreement, your use of the Site, or any products purchased must be filed within one (1) year after the cause of action accrues. Any claim not filed within this period is permanently barred. This limitation applies to all claims, whether based in contract, tort, statute, or any other legal theory, to the fullest extent permitted by applicable law.
Governing Law and Jurisdiction

Xylo Research Systems LLC, dba Panda Peptides shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including, without limitation, delays due to backorders of requested products, mail delays, customs delays, natural disasters, pandemics, civil unrest, or acts of government.
In the event of a force majeure delay, we will notify affected customers via email when reasonably practicable. If your order is delayed beyond 30 days due to circumstances beyond our control, you may cancel your order for a full refund by contacting support@pandapeptides.com.
Complete Agreement
Except as expressly provided in a particular “legal notice” on this Site, this Agreement constitutes the entire agreement between you and Xylo Research Systems LLC, dba Panda Peptides with respect to the use of this Site and Content.
